Our Privacy Policy, Terms of Use, and the information on this website are subject to change. By using this website, a Biodynamic customer portal, a franchisee portal, or a franchisee customer portal, by sending us email or text messages, by calling us, or by interfacing with us in any other way, you agree our Privacy Policy and Terms of Use will apply.

However, if we perform or agree to perform any services (the “Services”) or if we provide or agree to provide any materials (the “Materials” and collectively with the Services, the “Work”), you and we will sign a separate written contract for that Work (each, a “Contract”). If, and to the extent, there is any inconsistency, contradiction, or conflict between our Contract and our Privacy Policy, or between our Contract and our Website Terms and Conditions or any other information on this website, our Contract will control.

In addition, if you are a franchisee, you have signed our franchise agreement (the “Franchise Agreement”). If you are interested in becoming a franchisee, we may send you our franchise disclosure document and/or other franchise-related materials (collectively with the Franchise Agreement, the “Franchise Documents”). If and to the extent there is any inconsistency, contradiction, or conflict between our Franchisee Documents and our Privacy Policy or between our Franchise Documents and our Website Terms and Conditions (or any other information on this website), our Franchise Documents will control.

Our Privacy Policy does not cover information—personal or otherwise—we collect about job applicants, employees, and actual or potential suppliers, vendors, service providers, or independent contractors.

This Privacy Policy describes how Black Buck Enterprises LLC, an Oregon limited liability company doing business as Biodynamic (“Biodynamic”, “we,” “us,” or “our”) collects and uses the personal information we obtain from you, and it outlines your rights about your personal information, except this Privacy Policy does not cover information—personal or otherwise—we collect about job applicants, employees, and actual or potential suppliers, vendors, service providers, or independent contractors.

Personal Information

We collect, and during the past 12 months or more may have collected, the following types of personal information:

  • Personal identification such as your name, telephone number, and email address; your home or billing address; your user name, password, and log-in information for your Biodynamic customer portal; your IP address; and the following sensitive information (“Sensitive Information”): your drivers’ license number, and other government issued ID you or your agents disclose. We will not ask for your health data. If you chose to provide health data to us, we will use it only to perform the Work.
  • Property information such as the address of the property (the “Property”) where we may perform Services or provide Material (collectively, the “Work”); the record owner of the Property; the estimated value, square footage, and other features of the Property; the condition of the Property such as any structural, mechanical, or engineering issues and the presence of mold, asbestos, lead, or other harmful or potentially harmful substances; and the insurance coverage for the Property.
  • Internet and other electronic activity information such as your device and browser type, your browsing and search history, your interaction with us on our websites and other platforms.
  • Audio information such as voice recordings of customer service calls for training and quality assurance purposes.
  • Commercial and financial information such as records about the proposed or actual Work; your credit history; payment information; and the following types of Sensitive Information: bank account numbers, credit card numbers, debit card numbers, and related security codes.
  • For franchisees and potential franchisees, the educational, employment, professional information you provide, business ownership history and references, information about your experience, financial information (e.g., financial statements, including balance sheet, cash flow/income statements, etc.), property and business ownership, and other financial information.
  • Our interpretations and extrapolations are derived from the personal information we collect.

Why we collect Personal Information

We collect your personal information so we can answer your questions and better perform the Work. For example, we use your personal information to contact you from time to time; to provide you with information about our business; for customer support; to let you know about our Services and Materials as well as products and services offered by our affiliates we think you may be interested in; to analyze the placement and effectiveness of our marketing endeavors; and to help you obtain financing for the Work.

We also use personal information to monitor or improve our websites and platforms and our business; to help prevent fraud, detect violations of our Terms of Use and illegal activity, and to protect our rights and the rights and safety of others.

What else we do with Personal Information

We sell the following types of personal information to our affiliates who for the most part are also engaged in the home improvement business, so they can let you know about their products and services: your name, email address, physical address, and commercial information such as purchasing history information.

Applying certain states’ broad definition of “sell”, our cross-context behavioral digital advertising may involve the sharing or “sale” of personal identifiers (IP address) and internet or other electronic activity information with advertising networks and other companies we use to facilitate our digital advertising. They may use the information we sell them to reach the people most likely to be interested in the Work we and our affiliates provide. Those companies place cookies or other trackers on our websites and other platforms in order to collect, over time, information about your online activities across different websites and applications. Those companies may use the information they collect to provide personalized content to you about third party products and services that may interest you. We do not sell or share for cross-context behavioral advertising any of the other categories of personal information we collect.

Retention Periods

We retain your personal information for as long as necessary for us to (a) provide our obligations under our Contract and Franchise Documents; (b) comply with our legal obligations; and (c) protect our legal rights.

Sources Where We Collect Personal Information

We collect personal information from customers and other website users, and from representatives of entities with which we do business or may do business. We also collect personal information from potential franchisees, franchisees, references, and referral sources.

Use or Disclosure Personal Information

We do not use or disclose sensitive personal information for any purpose other than to perform the Work and our other obligations, and exercise our rights, in connection with our Contract, Franchise Agreements, and otherwise.

Business Purposes for Such Disclosures

We disclosed the preceding categories of personal information for the following purposes: to perform the Work; to manage customer, supplier and vendor accounts and relationships; to process payments; to verify customers’ identities; to fulfill orders and transactions; to engage in the advertising and marketing of our Work and those of our affiliates; to operate and secure our IT systems; to prevent fraud and other illegal activities; to obtain professional advice about legal and accounting matters; and to evaluate and manage franchise applicants and owners.

SMS Usage

Phone numbers collected via SMS consent are not shared with any third party or affiliate company for marketing purposes. All stated categories in this privacy policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. End users can opt out of receiving further messages by replying STOP or ask for more information by replying HELP. Message frequency varies. Message and data rates may apply.

Additional Information About How We May Disclose Personal Information

We may also share your Personal Information as required or permitted by law to comply with a subpoena or similar legal process or government request, or when we believe in good faith that disclosure is legally required or otherwise necessary to protect our rights and property or the rights, property or safety of others, including to law enforcement agencies, and judicial and regulatory authorities. We may also share your Personal Information with third parties to help detect and protect against fraud or data security vulnerabilities. And we may share or transfer your Personal Information to a third party in the event of an actual or potential sale, merger, reorganization of our entity or other restructuring.

Our Use of Cookies and Analytics

We and our service providers may use cookies, pixel tags, web beacons, and other small data files placed on your computer, tablet, mobile phone, or other devices that allow us to automatically collect certain information when you visit or interact with our website or other platforms (“Tracking Technologies”). We may use these Tracking Technologies to help us understand how you interact with our website and other platforms, to help identify irregular behavior, to prevent fraudulent activity and improve security, as well as to allow you to save your preferences.

We also allow certain of our service providers and other third parties to use Tracking Technologies for analytics and advertising. Personal Information of Minors

Our Services and Materials are not aimed at minors (i.e., anyone under the age of 18), and we do not knowingly sell or share the personal information of minors for purposes of behavioral advertising.

Do Not Track Signals

In certain web browsers, you can set Do Not Track (“DNT”) as a privacy preference. We do not respond to or honor DNT signals. We observe the Global Privacy Control signal.

Third Party Websites and Social Media

Our website may contain links to third party websites and social media buttons that link to social media platforms. Our Privacy Policy does not govern how third parties or social media platforms collect or use personal information, and we do not endorse or control their policies or practices. We are not responsible for the content or privacy practices of any third-party websites or platforms, and their privacy policies and terms of use govern their privacy practices.

How We Keep Your Personal Information Secure

We implement and maintain security appropriate for the types of personal information we collect, use, retain, transfer, or otherwise process. However, there is no perfect security, and even reasonable security processes involve risk management rather than risk elimination—i.e., we cannot eliminate all risk or prevent all data security incidents and breaches. Accordingly, any given incident or breach does not mean we failed to implement and/or maintain reasonable security.

We will review and update this Policy from time to time. If we make changes, we will reflect the date of the change. If the changes are material, you will be notified via email or a notice on our website.

For personal information we sell to or share with third parties for cross-context behavioral advertising, you have the right to opt out of those sales and sharing.

Opt-out Preference Signals
An opt-out preference signal is sent by a platform, technology, or mechanism on behalf of consumers and communicates the consumer’s choice to opt out of the sale and sharing of personal information for cross-context behavioral advertising with all businesses that recognize the signal, without having to make individualized requests. The signal can be set on certain browsers or through opt-out plug-in tools.

We recognize the Global Privacy Control signal and do so at the browser and device level, and it does not apply to personal information we collect offline or that we associate only with your name or email address. This means if the signal is sent through a specific browser on a specific device, we will recognize it for that browser and device only, and only for the identifiers for that browser on that device.  If you would like more information about opt-out preference signals, including how to use them, the Global Privacy Control website has such information (https://globalprivacycontrol.org/).

California Shine the Light

Our Commitment to Honoring Your Rights

If you exercise any rights described in this Privacy Policy, we will continue to treat you fairly. You will not be denied any Services or Materials. You will not be charged different prices or rates for our Services or Materials. You will receive the same level and quality of Services and Materials as those who chose not to exercise their rights under this Privacy Policy.

Exercising Your Rights and How We Will Respond

To exercise your rights to know, delete, or correct your Personal Information, or to ask a question, contact us at help@biodynamicusa.com. We will acknowledge receipt of your request within ten business days of our receipt of your request. We will provide a substantive response to your request as soon as we can, generally within 45 days after the date we receive your request, although in certain jurisdictions or under certain circumstances, we may take longer to process your request.  If we expect your request is going to take us longer than normal to fulfill, we will let you know.

You can direct us not to sell your personal information or share it for purposes of cross-context behavioral advertising by emailing us at help@biodynamicusa.com, and we will comply with your request no later than 15 business days after we receive it.

We usually act on requests and provide information free of charge, but in certain situations we may charge a reasonable fee to cover our administrative costs of providing the information. In some cases, the law may allow us to refuse to act on certain requests.  If that is the case, we will try to provide you with an explanation as to the reasons why.

Verification of Identity – Requests to Know, Delete or Correct

We will ask you for two pieces of personal information and attempt to match those to information we maintain about you. If we can’t verify your identity with the required degree of certainty, we will not be able to respond to the request. We will notify you to explain the basis of the denial.

Authorized Agents

You may designate an agent to submit requests on your behalf. The agent can be a natural person or a business entity. If you want to designate an agent to act on your behalf, you and the agent must comply with our verification process:

  • Requests to Know, Delete or Correct Personal Information: If the agent submits a request, the agent must provide us with your signed permission showing you have authorized the agent to submit the opt-out request on your behalf. You must also verify your identity directly with us and if you use an agent, you must confirm with us you gave the agent permission to submit the request.
  • Requests to Opt Out of Sale or Sharing: If the agent submits a request to opt out of the sale of your personal information or the sharing of your personal information for cross-context behavioral advertising, the agent must provide us with your signed permission indicating you have authorized the agent to submit the opt-out request on your behalf.

This subsection does not apply to agents authorized to act on your behalf under a valid power of attorney, and we will process those requests in accordance with California law governing powers of attorney.
